At FG Life, we are committed to protecting the privacy of our clients. This Privacy Policy outlines the personal information we collect, how we use it, who we share it with, and the steps we take to keep it secure. References to "we", "us" and "our" mean AIFP Personal Risk Ltd (trading as FG Life), 430 Ulster Street, Beerescourt, Hamilton 3200, New Zealand.

We handle all personal information in accordance with the Privacy Act 2020 and the Privacy Amendment Act 2025 (together, "the Act"), including the new Information Privacy Principle 3A (IPP 3A), which takes effect on 1 May 2026.

Your Authorisation

By providing us with your personal information or engaging us to provide financial advice services, you consent to the collection, use, storage, and disclosure of that information in accordance with this Privacy Policy.

Information Collection and Use

We collect personal information — such as your name, address, phone number, email address, financial position, health status, and credit history — for the purpose of providing personalised financial advice and insurance recommendations that meet your specific needs, circumstances, and goals.

Indirect Collection of Personal Information — IPP 3A Notice

In addition to information you provide to us directly, FG Life sometimes collects personal information about you from third parties (indirect collection). Under Information Privacy Principle 3A of the Privacy Amendment Act 2025 (effective 1 May 2026), we are required to notify you of the following matters when we do so:

  • Fact of indirect collection: We may collect personal information about you — including health information and credit history — from sources other than you personally.

  • Purpose of collection: To assess your insurance needs and financial circumstances, to confirm information you have provided, and to prepare and present suitable insurance recommendations to you under our obligations as a licensed financial advice provider. This includes verifying health status for underwriting and confirming employment and income for income protection cover.

  • Intended recipients of your information:

    • Life and health insurance product providers (personal risk insurance industry, NZ-based): Chubb Life Insurance NZ Ltd, Fidelity Life Assurance Company Ltd, NIB NZ Ltd, Partners Life Ltd, Southern Cross Medical Care Society.

    • Professional referral partners (professional services sector — accounting, legal, and mortgage broking sub-sectors, NZ-based): for example, accountants or lawyers who referred you to us or to whom we refer you for complementary advice.

    • Compliance auditors (audit and assurance services, financial advice sector, NZ-based): engaged to verify that our advice is in your best interests.

    • Cloud and software service providers (information technology and cloud computing industry, overseas — primarily Australia and India): third-party platforms used to store, process, and manage client records on our behalf.

    • Regulatory and government bodies (financial services regulation and tax administration, New Zealand): including the Financial Markets Authority (FMA), Inland Revenue (IRD), and other government agencies where disclosure is required by law.

  • Legal authority for collection: The collection of personal and sensitive information (including health and credit information) is required under Part 3 of the Financial Markets Conduct Act 2013 (FMC Act), which requires FG Life, as a licensed Class 2 Financial Advice Provider, to gather sufficient information about clients to ensure that advice is suitable for their individual circumstances. This obligation is reinforced by the Code of Professional Conduct for Financial Advice Services (issued under s 402 of the FMC Act). The Privacy Act 2020 and Privacy Amendment Act 2025 govern how all collected information must be handled.

  • Your right to access and correct your information: You have the right to request access to, and correction of, any personal information we hold about you at any time. To make a request:

    • Email info@fglife.co.nz with the subject line "Privacy Request", or

    • Call 0800 344 700, or

    • Write to: Privacy Officer, FG Life, 430 Ulster Street, Beerescourt, Hamilton 3200.

    We will acknowledge your request within 5 business days and respond within 20 working days, as required under the Privacy Act 2020.

Where we collect your personal information indirectly, we will notify you of the above matters as soon as reasonably practicable after collection. Where possible, we provide advance notice via this Privacy Policy, our Disclosure Statement, and the Statement of Advice we provide to you at the start of the engagement.

Authorised Representatives
Attorneys and Court-Appointed Representatives (PPPR Act)

If we collect your personal information through an attorney acting under an enduring power of attorney, or a welfare guardian or property manager appointed by the Family Court under the Protection of Personal and Property Rights Act 1988 (PPPR Act), that representative is treated as standing in your shoes. This is considered direct collection (IPP 3 applies). We will provide privacy notices directly to the representative who acts in your place.

Other Representatives (Parents, Guardians, Lawyers, Advocates)

If we collect your personal information through a parent, guardian, lawyer, or other advocate acting on your behalf outside the PPPR Act, this is considered indirect collection (IPP 3A applies). FG Life will provide all required IPP 3A privacy information to your representative and it is their responsibility to ensure you are informed of the matters set out in the IPP 3A Notice section above.

Why do we collect your Personal Information?

To provide you with financial advice and recommendations for insurance products and services that suit your circumstances, needs, and objectives, we need to collect your personal information.

We may also collect personal information (including credit history and health status) on behalf of insurers and other product providers when you apply for a policy. Product providers have their own Privacy Policies that govern information collected on their behalf.

Under no circumstances do we sell your information or share it with third parties unless permitted by you.

How do we collect your Information?

Generally, we collect your personal information directly from you — for example, through our website contact form, emails, meetings, or questionnaires.

We may also collect your personal information indirectly from:

  • with your authorisation, banks and employers;

  • insurance product providers; and

  • any other person authorised by you.

If you provide personal information about another person to us (the Other Person), you confirm that you have collected their information in accordance with the Act, and that the Other Person has:

  • authorised its disclosure to us and our collection, use and disclosure of that information in accordance with this Privacy Policy; and

  • been informed of their right to access and request correction of their personal information.

Information Sharing and Disclosure

We do not sell, rent, or share personal information with third parties, except as necessary to provide financial services or as required by law. We may disclose your personal information to:

  • Product providers and prospective insurers.

  • Referral partners who can assist with your circumstances and goals.

  • Investors, or any entity with an interest in our business, or to whom we may assign rights or obligations, or sell our business.

  • Regulatory bodies and the Government, where legally required.

  • Auditors, to verify that the services we provide are in your best interests.

  • Your employer, referees, credit reporting agencies, and identity verification agencies.

  • Any other person or entity authorised by you.

Before disclosing your personal information to any other person or organisation, we will take all reasonable steps to ensure they comply with the Act and have committed to protecting your information to at least the same standard as we do.

Disclosure of Personal Information Outside New Zealand

We may use cloud storage to store your personal information. The cloud storage and data centres may be located outside New Zealand.

To provide you with our services, we may need to share your information with organisations outside New Zealand — for example, information technology providers based in India or Australia.

Your Rights

Under the Privacy Act 2020 and Privacy Amendment Act 2025 (including IPP 3A), you have the right to access and request corrections to any personal information we hold about you.

Security
